Federal Judge Attempts To Overrule DOJ, Throw General Flynn In Jail
May 14, 2020Shortly after the Justice Department dropped the criminal case against former National Security Adviser Michael Flynn, who was previously accused of lying to law enforcement about his contact with Russian during the FBI’s Russian collusion investigation against President Trump, a federal judge moved forward with an attempt to delay the dismissal of the case, ordering that the investigation continue with a questionable decree.
The unbelievable ruling from federal judge Emmet Sullivan asked another former federal judge to appear in court to make an argument as to why the Justice Department should not drop the case against President Trump National Security Adviser, along with claiming that General Flynn should be thrown in jail for perjury.
Check out what Law and Crime reported below:
Federal Judge Emmet G. Sullivan late Wednesday issued a stunning ruling in the prosecution of Michael Flynn, President Donald Trump‘s former National Security Advisor. The two-pronged order (1) appoints a former federal judge to argue against dismissing the case; and (2) considers holding Flynn in criminal contempt for perjury.
“Upon consideration of the entire record in this case, it is hereby ORDERED that the Court exercises its inherent authority to appoint The Honorable John Gleeson (Ret.) as amicus curiae to present arguments in opposition to the government’s Motion to Dismiss,” the judge wrote. “[I]t is further ORDERED that amicus curiae shall address whether the Court should issue an Order to Show Cause why Mr. Flynn should not be held in criminal contempt for perjury pursuant to 18 U.S.C. § 401, Federal Rule of Criminal Procedure 42, the Court’s inherent authority, and any other applicable statutes, rules, or controlling law.”
After the election, critics of both President Trump and his affiliates claimed that General Flynn’s statements to officials at the FBI about his contacts with Russian officials warranted criminal prosecution, even though it was recently reported that the FBI was already planning to close the case, but tried to incriminate Michael Flynn anyways during an interview.
Former National Security Adviser Michael Flynn has battled the charges stemming from Special Counsel Robert Mueller’s investigation for several years, but the Justice Department finally made a stunning reversal in the criminal case this month after Flynn’s legal team obtained documents revealing that top FBI officials tried to “get him to lie” or “get him fired.”
Additionally, the Director of National Intelligence recently declassified particularly troubling documents with the help of Republican Senators, revealing that high profile names in the Obama administration requested that the identity of Michael Flynn be released.
President Trump has been an ally of Michael Flynn throughout the entirety of the criminal investigation against him, explaining that he was targeted by “dirty, filthy cops at the top of the FBI.”
“It should never be allowed to happen in this country again,” he added.
