The Department of Justice (DOJ) is investigating a company accused of failing to provide personal protective equipment (PPE) to Maryland and California, The Washington Post reported Wednesday.

The DOJ has opened an investigation into Blue Flame Medical after the company did not deliver coronavirus-related medical equipment that it agreed to provide in state contracts. The states have since canceled the contracts.

Prosecutors are examining at least two contracts with Maryland and California, two individuals familiar with the matter told the Post. 

Blue Flame Medical’s attorney Ethan Bearman said in a Tuesday statement that the company “is devoted to getting masks and ventilators” to Maryland.

He said the firm plans to “honor that contract” by June 30, the delivery deadline in the purchase order. But a Blue Flame invoice obtained by the Post shows the shipping date was scheduled for April 14. 

Bearman declined to comment to the Post about the investigation. 

The Justice Department did not immediately return a request for comment. 

The company, which was formed by two GOP operatives in March, started selling coronavirus supplies as the pandemic began to strike the country. A week after its creation the company made a pitch to Maryland.

Maryland officials canceled their state's $12.5 million contract with Blue Flame Medical for ventilators and PPE, telling The Wall Street Journal over the weekend that they never arrived. 

California also hired the company for a $457 million deposit to produce 100 million face masks, two individuals familiar with the transaction told the Post. The state's contract was first reported Tuesday by CalMatters before officials canceled it and sought to get the state's money returned.

Michael Ricci, a spokesman for Maryland Gov. Larry Hogan (R), told the Post in an email that the federal prosecutors had sent subpoenas to the state regarding the Blue Flame order. The attorney general in Maryland is also investigating the incident. 

Blue Flame Medical was created by Michael Gula, a GOP fundraising and lobbying consultant in Washington, and John Thomas, a California political consultant.
