RIGHTS TRAMPLED: James O'Keefe Sues FBI After Being Denied the Right To Buy A Gun
August 7, 2020Anyone who believes in true investigative reporting owes a debt of gratitude to James O’Keefe, founder of Project Veritas.
For years now, he and his undercover journalists have uncovered graft, corruption and ill-intent. The organization has even uncovered the Left-wing bias of other media organizations like CNN.
So of course, along the way, O’Keefe has made some enemies. And just this week he found out the extent the deep state will go to in preventing him from enjoying all of his constitutional rights.

In a video posted to the organization’s website on Thursday, O’Keefe explains how he was denied his Second Amendment right to keep and bear arms after an FBI background check oddly claimed he was a felon and, thus, prohibited from buying guns.
The Blaze reports:
Project Veritas' James O'Keefe posted a video Thursday, in which he was purportedly denied the right to purchase a firearm due to an erroneous entry in the FBI's National Instant Criminal Background Check (NICS) system. The interactions led O'Keefe to file a lawsuit against the FBI in order to have his name removed from the registry.
"The lawsuit is being filed in the Southern District Court of New York seeking an order requiring the FBI to remove him from this list as required by law under 18 U.S.C. § 925A,” said Jered Ede Esq., who is representing O’Keefe.
“Notably, the FBI has not disclosed what information it is relying on to place him on its watch list,” Ede stated in the complaint filed with the court.
"This is patently false,” Ede further. “Mr. O’Keefe has never been convicted by any court anywhere of any crime punishable by more than a year of imprisonment.”
“Simply put, the FBI’s placement of Mr. O’Keefe on the NICS deny list for felons is wholly and unequivocally improper and based on demonstrably false information. Notably, the FBI has not disclosed to Mr. O’Keefe what information it is relying on to place Mr. O’Keefe on its watchlist.”
In the video, O’Keefe wonders aloud if he is being ‘targeted’ by the FBI because of his organization’s journalism. One gun shop owner agrees; another said if that’s the case then O’Keefe has a suit on his hands.
Now, the Project Veritas Founder isn’t with a record.

"Of note, O'Keefe was charged with a felony of entering federal property under false pretenses for his actions related to an attempted sting operation against former Sen. Mary Landrieu. They ended up pleading guilty to a misdemeanor count of entering a federal building under false pretenses. He was ordered to pay a fine and serve two years of probation," The Blaze reported.
"That charge, however, carried a maximum jail sentence of six months. However, it is within the realm of possibility that some states may bar persons who were charged with felonies but pled down to misdemeanors from owning a firearm. Additionally, it is possible that O'Keefe's name was entered into the NICS database when he was charged, but never removed when the plea was actually entered," the site noted further.
Interestingly – and this point is never litigated adequately – the Second Amendment’s “shall not be infringed” clause does not come with any qualifiers like ‘no prior convictions of crimes.’
