AHEAD OF PRESIDENT-ELECT JOE BIDEN’S inauguration on Tuesday, the 1.4-million member International Brotherhood of Teamsters is hoping to remind Biden — and the Democratic leaders now in control of Congress — of the union’s priorities. It plans to launch a grassroots “Build Back Stronger” campaign today to push for seven pages of policy changes that organized labor has been seeking for years, according to a copy of the proposal shared with Morning Shift.

Topping the list: a fix for the multiemployer pension crisis and beefed-up workplace safety enforcement amid the coronavirus pandemic.

SO WHAT’S DIFFERENT THIS TIME AROUND? Teamsters General President James P. Hoffa tells MS he’s hoping to capitalize on Democrats’ razor-thin majority in the Senate. “Everything we tried to do over the past years, we always ran into Mitch McConnell, and he stopped us every time,” Hoffa told MS in an interview.

Congress has been slow to address the insolvency of the multiple giant pension funds negotiated by labor unions across entire industries. The federally chartered Pension Benefit Guaranty Corp. currently insures the plans, but the failure of the Teamsters’ Central States Pension Fund alone would bankrupt the agency. Absent congressional action, the agency is projected to be insolvent by 2026.

The Teamsters are calling on Congress to either adopt plans that would allow the PBGC to "partition" these multiemployer pensions and take control of a part of the plan’s responsibilities, or create a new Treasury agency empowered to issue bond-backed loans to faltering plans.

“The president [and] the Democrats all know this is our No. 1 priority,” Hoffa told MS. “This affects not only Teamsters, but many many working families.”

The union is also calling on the Occupational Safety and Health Administration to issue workplace safety regulations for Covid-19, as well as for heat and ergonomic hazards. In addition, the Teamsters want Biden to help pass the Protecting the Right to Organize Act and the Public Service Freedom to Negotiate Act, both of which would broadly expand workers’ ability to form unions, as well as direct the NLRB to allow for union elections to be held remotely.

More broadly, the Teamsters want the Biden administration to roll back President Donald Trump’s recent efforts to make it easier for companies to classify their workers as independent contractors, and want the Labor Department to expand the number of workers entitled to overtime pay.

BIDEN GETS TO WORK: Expect a flurry of executive actions from the incoming president, our Tyler Pager reports. After being sworn in on Wednesday, Biden will rescind the travel ban on several majority-Muslim countries and extend limits on student loan payments and evictions instituted during the pandemic, Tyler writes.

Incoming White House Chief of Staff Ron Klain outlined Biden’s first 10 days in office in a memo to senior staff on Saturday. For example:

On his second day, Biden will sign executive actions focused on addressing the Covid-19 pandemic, including actions meant to help schools and businesses reopen safely, increase testing, protect workers and establish clearer public health standards.

And on his third day, Biden will direct his Cabinet to work on delivering economic relief to families most affected by the crisis.

Biden also plans to expand “Buy America provisions” in the subsequent days, as well as take action to advance “equity and support communities of color” and work toward reuniting families separated at the border, among other actions.

DEETS ON BIDEN’S IMMIGRATION PUSH: Congress hasn’t been able to agree on significant immigration reform since 1986. But Democrats and advocates are already “drafting legislation, taking the temperature of Republicans — and gearing up for what they hope will be the defining chapter in a decadeslong battle to pass a pathway to citizenship for all undocumented immigrants,” our Laura Barrón-López and Sabrina Rodriguez write.

“Top Latino and immigrant advocacy groups who’ve seen details of the coming package said they were stunned by the boldness of Biden’s plan,” which he has said he will introduce “immediately” after his swearing-in on Wednesday.

Here’s what they told Laura and Sabrina:

— The bill would give 11 million undocumented immigrants a pathway for citizenship, with an eight-year wait as a permanent resident.

— Biden will issue an executive order instituting a “four-year extension” of the Deferred Action for Childhood Arrivals program.

— Biden said he may not be able to pass the legislation in “100 days,” as he had promised, because impeachment proceedings in the Senate could slow things down.

OTHER MOVEMENT ON THE HILL: Rep. Joaquin Castro (D-Texas), backed by more than a dozen labor and immigrant rights groups, “said he is planning to introduce legislation allowing undocumented essential workers to apply for permanent resident status,” according to Laura and Sabrina. “Under the bill, those workers would be eligible to apply for citizenship in five years.”

MAYORKAS NOMINATION HEARING TODAY: The Senate Homeland Security and Governmental Affairs Committee will hold a hearing this morning to vet Alejandro Mayorkas, Biden’s pick to serve as DHS secretary. If confirmed, the Cuban-born Mayorkas would be the first Latino to lead the department. He would also be key in Biden’s plan to extend the DACA program, which he oversaw as director of United States Citizenship and Immigration Services under President Barack Obama.

Expect questions about his handling of the EB-5 investor visa program during his time at USCIS. A 2015 report released by the DHS Office of Inspector General found Mayorkas “created an appearance of favoritism and special access” in dealings with an investment center tied to then-Virginia Gov. Terry McAuliffe and Tony Rodham, the late brother of Hillary Clinton.

Senators may also ask about Mayorkas’ work over the past two years as a corporate lawyer representing and advising companies including Airbnb and Uber, which, our transition team notes, “could be a hurdle for Mayorkas with some progressive senators.” The hearing starts at 10 a.m. More info and a livestream.

FOOD WORKERS FIGHT FOR VACCINE ACCESS: The food industry “is clamoring to prioritize frontline food workers who kept Americans fed throughout the worst of the pandemic even as thousands of them fell sick and hundreds died,” our Ximena Bustillo and Ryan McCrimmon report. “But limited doses and a haphazard patchwork of distribution plans are leading to fears that thousands more workers will get hit — potentially stymieing food production in the coming weeks and months.”

WHAT WILL BIDEN DO? The president-elect is pushing for a $20 billion national vaccine program, but the plan doesn’t specifically address the needs of food and ag workers.

HERE’S THE RUB: The CDC’s guidelines designate meat processing, grocery store, and food and agriculture workers as “non-health care frontline essential workers,” part of the second tier of vaccine priority, Ximena and Ryan write. But the federal government is letting states figure out their own plans for distribution — some of which leave out agriculture workers altogether.

COVID-19 SHOTS AT SCHOOL? “Los Angeles Unified Superintendent Austin Beutner is calling on state and local health officials to immediately allow the district to turn its more than 1,400 schools into Covid-19 vaccination sites, focusing on shots for teachers and school staff,” our Mackenzie Mays reports. “California has prioritized teachers among vaccine recipients but left distribution up to counties, and there is no large-scale effort yet to inoculate school employees in the state.”

It's unclear when the bulk of California’s 300,000-plus teachers will get the vaccine, according to Mackenzie, but Beutner asked California officials on Monday to immediately authorize his school system — the second-largest in the U.S. — to vaccinate its teachers and school staff.

AMAZON WORKERS TO HOLD UNION VOTE NEXT MONTH: Some 6,000 Amazon workers in Bessemer, Ala., will begin voting next month on whether to form the e-commerce giant’s first U.S. union, Alina Selyukh reports for NPR. “The National Labor Relations Board on Friday scheduled the vote by mail because of coronavirus concerns. It will begin Feb. 8 and continue through March 29.” The workers are deciding whether to join the Retail, Wholesale and Department Store Union.
