A Milwaukee-area police chief whose officer is under internal investigation after fatally shooting a Black teenager on Monday said that he did not think the officer should not be fired.

The Associated Press reported that Chief Barry Weber of the Wauwatosa Police Department said during a news conference that Ofc. Joseph Mensah, who is also Black, should not be fired as a result of a pending investigation by the Wauwatosa Police and Fire Commission, of which Weber is a member.

“I’ve never heard of any police officer ever being disciplined for something they may or may not do in the future,” Weber said, according to the AP.

“Joseph Mensah’s been cleared by the district attorney in three different cases. There’s been no reason to this point, and none that I can see, [for why] he should be removed from the force," he added.

Mensah came under investigation by the eight-member commission after February's shooting of Alvin Cole, 17, who was killed outside a local mall. Police say that Cole fired upon Mensah, which Cole's family has disputed.

District Attorney John Chisolm declined to bring charges against Mensah, who is suspended with pay by the department, last week stating that he didn't believe that prosecutors could disprove that Mensah acted in self-defense.

"I do not believe that the State could disprove self-defense or defense of others in this case and therefore could not meet the burden required to charge Officer Mensah. With this I conclude my criminal review of the matter," Chisolm said.

Wauwatosa's mayor, Dennis McBride (D), has said recently that he does not want to put pressure on the commission either way regarding Mensah's future with the police department, though in the past he has reportedly questioned whether the officer should remain with the department.

Kimberly Motley, an attorney representing Cole's family, blasted Weber's comments in a statement to the AP on Monday.

“I think that position of the chief is another reason why he needs to be terminated as well,” Motley told the news service. “Joseph Mensah is not credible and neither is Chief Weber.”
